DeCastro v. Las Vegas Metropolitan PD et al

On July 10, 2026, Jose DeCastro filed yet another lawsuit against the Las Vegas Metropolitan Police Department and others. This time his complaint is based on alleged Civil Rights violations that occurred while incarcerated following his conviction in State of Nevada (LVMPD) v. Jose DeCastro(Case 23-CR-013015)that was later reversed on appeal(Case C-24-381730-a).
There is speculation that many of the incidents listed in his complaint occurred outside Nevada's 2-year statute of limitations. Nevada appears to start the clock based on the date an incident occurred while in jail and not on a person's release date. The date of this filing, being 1-day before the 2-year anniversary of his release from the Clark County Detention Center, could make any incident that occurred prior to his last day in jail time barred.

At his September 1st pre-trial hearing, DeCastro was offered a plea deal whereby he could plead "No Contest" to the charge and only get time servered. DeCastro rejected the offer and a trial date was set. The trial is now scheduled for November 9, 2026, at 2 PM. -

Jose DeCastro filed an appeal of the loss in hisCalifornia civil case 23SMCV0058, DeCastro v. Peter,in which he also sued Michel Pieratini and has been has been order to pay sanctions and fees. While notice of the appeal was filed in November of 2025, a case was not opened on the Appellate Case website until April 9, 2026.
On May 28, 2028, the Court of Appeals for the 2nd Appellate District issued an Order DISMISSING the appeal (Cal. Rules of Court, rule 8.264(b)(1)). No party submitted a Motion for reinstatment within the 15 day window and the FINAL order DISMISSING the Appeal posted on August 25, 2026.

The BWC video shows the entire length of the traffic stop, from pulling over until the officer left the scene, lasted a total of 17-18 minutes. In his complaint, Mr. DeCastro claims he was in handcuffs for "approximatly 20 to 30 minutes or longer." [Complaint Paragraph #31].
On November 21, 2025, Jose DeCastro filed another Federal lawsuit in Nevada, this time against the Nevada Highway Patrol officers who conducted a traffic stop on November 22, 2023 inState of Nevada (NHP) v. DeCastro.

On August 5, 2025, Jose DeCastro filed another Federal lawsuit, this time in the Northern District of California, against another YouTube contect creator with the channel called 'Irish Demon' who he names as John Brendan O'Dea. This time, electing not to file Pro Se, the suit was file by Randall S. Newman, who is listed as the Attorney for Plaintiff. This suit alleges a number of violations of various Federal Acts, California Penal code, and Copyright, to name a few. The defendant is this case is not a citizen of the United States but is, according to the suit, a resident of Ireland.

On June 3, 2025, Jose DeCastro filed another Federal lawsuit, this time returning to Massachusetts District Court. In this case he filed defamation claims against Dale Hiller, who runs the YouTube channel 'LackLuster' that tends to focus on videos made by people who are commonly referred to as 'First Amendment Auditors.' The coverage on LackLuster's channel, while similar to that covered on Jose DeCastro's DeleteLawz YouTube channel, has a subscriber base that was somewhere around 3 times the size of DeCastro's at the time of the incidents that DeCastro is suing over.
On September 25, Judge Burroughs dismissed DeCastro's Complaint for lack of jurisdiction. Being Pro Se, in docket # [35], DeCastro was given 21 days to file a 2nd Amended Complaint.

On May 21, 2025, Jose DeCastro filed another civil suit in Nevada in retaliation for his arrest and conviction in State of Nevada v. Jose DeCastro, which was later overturned on appeal. This time attempting to use a Monell claim to pierce judicial and qualified immunity of the Judge who sentenced him, the Judge who refused to release him on bail pending his appeal (even though she eventually reverse his conviction), the prosecuting attorney, the LVMPD officer who testified against him, a bailiff, and others. His lawsuit is claiming damages starting at 29 million dollars ranging to a high of 50 million.

On March 5, 2024. Jose Maria "Chille" DeCastro made the unusual move of filing another lawsuit against the Officers and Officials in Ironton, Ohio, but this time in Nevada State Court. This appeared to be another attempt to sue the defendant's that he sued and lost to in Ohio Federal court. That case was dismissed with prejudice. And he lost a later appeal in the Federal 6th District. The day before filing this case in State court, he filed a new Federal suit in Nevada against Ohio defendants that was then transferred back to Ohio.

On April 17, 2023, Mr. DeCastro went live on YouTube and stated that he was about to file a Federal lawsuit against Las Vegas Metropolitan Police Department, the State of Nevada, numerous officers and John Does. This appears to be in retaliation for his March 15 arrest for Obstruction and Resisting during which Mr. DeCastro can be heard making claims that the officers were violating his rights for turning off his phone which was running a live stream on YouTube, and that an officer holding his arm to restrain him was torture. Shortly afterward, the case appeared on PACER with a case number and Judge assignment.
