On July 10, 2026, Jose DeCastro filed yet another lawsuit against the Las Vegas Metropolitan Police Department and others. This time his complaint is based on alleged Civil Rights violations that occurred while incarcerated following his conviction in State of Nevada (LVMPD) v. Jose DeCastro(Case 23-CR-013015)that was later reversed on appeal(Case C-24-381730-a).
There is speculation that many of the incidents listed in his complaint occurred outside Nevada's 2-year statute of limitations. Nevada appears to start the clock based on the date an incident occurred while in jail and not on a person's release date. The date of this filing, being 1-day before the 2-year anniversary of his release from the Clark County Detention Center, could make any incident that occurred prior to his last day in jail time barred.
This case has been randomly assigned to the same Judge who is handling his Federal lawsuit against the Nevada Highway Patrol officers(Case 2:25-cv-02331)and the same Magistrate Judge who is handling his other 2026 Federal lawsuit against LVMPD(Case 2:26-cv-00373).
