On August 5, 2025, Jose DeCastro filed another Federal lawsuit, this time in the Northern District of California, against another YouTube contect creator with the channel called 'Irish Demon' who he names as John Brendan O'Dea. This time, electing not to file Pro Se, the suit was file by Randall S. Newman, who is listed as the Attorney for Plaintiff. This suit alleges a number of violations of various Federal Acts, California Penal code, and Copyright, to name a few. The defendant is this case is not a citizen of the United States but is, according to the suit, a resident of Ireland.
DeCastro was originally seeking A) Compensatory Damages to possibly exceed $75,000; B) Putitive damages in an amount sufficient to pubish Irish Demon (O'Dea) and deter future misconduct; C) Statutory damages to the extend permitted by law; D-E) Injunctions enjoining Irish Demon from a number of actions; F) An order requiring Irish Demon to disorge profits, monetization revenue and more; G-I) A number of other actions including the awarding of attorneys' fees and costs.
On September 14, 2026, DeCastro was GRANTED a Default Judgement agaist O'Dea for the DMCA claim and all other claims were dismissed without prejudice. DeCastro was only awarded a $405 refund of his filing fee from O'Dea, and O'Dea was ordered to removed 2 videos from October and November of 2022 and ordered not to repost or rebroadcast them.
