On June 3, 2025, Jose DeCastro filed another Federal lawsuit, this time returning to Massachusetts District Court. In this case he filed defamation claims against Dale Hiller, who runs the YouTube channel 'LackLuster' that tends to focus on videos made by people who are commonly referred to as 'First Amendment Auditors.' The coverage on LackLuster's channel, while similar to that covered on Jose DeCastro's DeleteLawz YouTube channel, has a subscriber base that was somewhere around 3 times the size of DeCastro's at the time of the incidents that DeCastro is suing over.
On September 25, Judge Burroughs dismissed DeCastro's Complaint for lack of jurisdiction. Being Pro Se, in docket # [35], DeCastro was given 21 days to file a 2nd Amended Complaint.
DeCastro has also included 2 other YouTube content creators who reside in Massachusetts. Both Josh Abrams aka 'Accountability For All' and Kate Peters aka 'Masshole Mafia' were both unsucessfully sued in Federal court by DeCastro in 2022, and that was after he made 2 failed attempts to obtain protection orders against them in State court earlier that same year.
There has been speculation that the only reason Mr. DeCastro elected to file in Massachusetts is that Massachusetts has a 3-year statute of limitations while the statute of limitations appears to have run out in the California, believed to be the home State of Dale Hiller and the home State of Jose DeCastro. Feedback from those who have read through this latest attempt at a lawsuit believe it is a rehash of previous claims that Mr. DeCastro may have difficulty proving, and he may be very close to having missed the cutoff for Massachusetts statute of limitations.
On December 9, 2025, District Judge Sorokin GRANTED Josh Abrams' motion to have the case transferred to Judge Allison D. Burroughs. The request was made due to the fact that Judge Burroughs heard and dismissed the 2022 case of DeCastro v. Abrams, Peter, YouTube (Google) et al and this case was filed against 2 of the defenants who were listed in the previous case, and contains elements that are identical to the previous case.
