At his September 1st pre-trial hearing, DeCastro was offered a plea deal whereby he could plead "No Contest" to the charge and only get time servered. DeCastro rejected the offer and a trial date was set. The trial is now scheduled for November 9, 2026, at 2 PM.

On July 3, 2026, Jose Maria DeCastro was arrested for Obstructing/False Info To P.O. while, according to his version on a live stream posted July 4, attending First Friday in Las Vegas. Later in the day on July 4, DeCastro posted a YouTube short of the video from his point of view with only minor editing. Shortly afterwar he made the vide private, then later published another version.

The video shows an officer in a patrol vehicle pulling up behind DeCastro and giving a couple of quick taps of the siren to get DeCastro's attention. Over the PA system the officer instructs DeCastro to get on the sidewalk. After parking, the officer he exited the vehicle and began to cross to the other side of the street and away from DeCastro. DeCastro follows the officer in what appears to be an attempt to argue the law while advancing further into the street in defiance of the officer's prior instructions. As DeCastro advances on the officer from behind, the officer quickly turns around and places DeCastro in handcuffs.

DeCastro re-hired Michael Mee as his attorney, not Josh Tomsheck, after multiple fundraisers and a GoFundMe account where he attmpted to raise $15,000 to hire Attorney Tomsheck.

On August 4, 2026, at his arraignement hearing, the initial Judge recused himself. Jose DeCastro did not appear in person but is rumored to have been watching theOur Neveda Judgeslive stream.

A pre-trial hearing was set for September 1, 2026. More information will be posted as it becomes available.
