DeCastro v. John Doe Officers

The BWC video shows the entire length of the traffic stop, from pulling over until the officer left the scene, lasted a total of 17-18 minutes. In his complaint, Mr. DeCastro claims he was in handcuffs for "approximatly 20 to 30 minutes or longer." [Complaint Paragraph #31].

On November 21, 2025, Jose DeCastro filed another Federal lawsuit in Nevada, this time against the Nevada Highway Patrol officers who conducted a traffic stop on November 22, 2023 inState of Nevada (NHP) v. DeCastro.

During the stop, Mr. DeCastro was detained and placed in handcuffs for approximately 8-9 minutes, based on the Body Worn Camera timestamps, after he made an illegal U-turn to confront the officers and a license or NCIC check came back with notations for potential 'violent tendencies' and his warrant out of Ohio.

While DeCastro claimed to not know the identities of the officers and filed against 20+ John Does, the primary officer was listed on the citation and his name and ID were published in theState of Nevada (NHP) v. On August 10, 2026, the Court Dismissed the case without prejudice when DeCastro failed to serve the Defendants. While it was dismissed without prejudice, the statute of limitations has passed so the case cannot be refiled.
