Appeal of 23-DR-013015: Nevada (LVMPD) v. DeCastro

On March 26, 2024, a hearing on Jose DeCastro's appeal of his conviction and 180 day sentence was scheduled. The hearing date is July 10, 2024, at 9:00 AM.

A hearing was held on April 1, 2024, in front of Judge Zimmerman on a montion for bail and release pending his appeal. The motion was DENIED. He will not be allowed out on bail.

This is an appeal of Nevada v. DeCastro (23-CR-013015)

On July 10, 2024, the appeal was heard and GRANTED, with his conviction on Case# 23-CR-013015 reversed

DeCastro v. McKnight et al

On March 5, 2024. Jose Maria "Chille" DeCastro appears to have made the unusual move of filing another lawsuit against the Officers and Officials in Ironton, Ohio, but this time in Nevada State Court. Not much is known about this filing, but it appears to be another attempt to sue the defendant's that he sued and lost to in Ohio Federal court. That case was dismissed with prejudice. He is currently appealing that decistion in the Federal 6th District. Then, the day before filing this case in State court, he filed a new Federal suit in Nevada against Ohio defendants.

Both these new Federal and State lawsuits have issues due to the earlier dismissal with prejudice, and with juridiction as filing in Nevada for both of these cases is questionable.

City of Las Vegas v. DeCastro

Multiple parties have requested the arresting officer's body worn camera (BWC) video. Now that the case has been dismissed, we are attempting to obtain a copy.

On February 15, 2024, Jose Maria DeCastro was arrested for Obstructing/False Info To P. O. We are currently gathering more information and will update this page as the details and documents become available.

An arraignment was held on March 18, 2024. At that time, Jose DeCastro plead 'not-guilty' and the next step in the process was scheduled. Initally, a pre-trial hearing/conference was schedule for May 1st, 2024, but that was continued multiple times and was scheduled for August 13, 2024, at 1:30 PM Pacific Time.

On August 8, 2024, the case docket shows the case being dismissed and the August 13th pre-trial vacatated. Since the status also shows the case as closed, it appears the prosecutor has dismissed the case.

State of Nevada (NHP) v. DeCastro

On November 22, 2023, Jose Maria DeCastro was issued a citation by the Nevada Highway Patrol while driving on the Las Vegas Freeway ( IR 15 ) at mile marker 8. While Mr. DeCastro did not release his own version of the traffic stop as he so often does, Body Worn Camera footage has been obtained and is very informative.

At the request of Jose DeCastro, the original hearing to contest his November 22, 2023, citation for Failure to Obey a Traffic Control Device was postponed and a new hearing date was set for Tuesday, April 23, 2024.

On April 23, 2024, the hearing was held and, due to his incarceration in the Clark County Detention Center as a result of a guilty verdict in Nevada v. DeCastro (23-CR-013015), Jose DeCastro was not in attendance. The Defendant was found to have commited the infraction, his $415 penalty stands and was paid from the cash bond that Mr. DeCastro was required to post to contest the citation.

DeCastro v. Las Vegas Metro. PD et al

On March 15, 2023, Jose Maria DeCastro was charged with Obstructing a Public Officer and Resisting a Public Officer when, while broadcasting live on his Delete Lawz YouTube channel, he recorded himself interfering with a Las Vegas Metro Police Department traffic stop. His information briefly appeared on the Clark County Inmate Lookup website. Based on a video posted by Mr. DeCastro a short time after the arrest appeared on the court website, and the fact that his jail information was removed within a few hours, his time in jail was relatively short.

On Tuesday, March 19, 2024, Jose DeCastro was found Guilty on both counts. He was sentenced to 90-days on each, with the sentences to run consectutively. He appealed to theNevada Eighth Judicial District Court. In the meantime, Mr. DeCastro filed a motion for bail and release pending his appeal. On April 1, 2024, Judge Zimmerman DENIED the motion. He then filed a motion for bail and release to the Eighth Judical District Court, which was denied on April 9, 2024.

On July 10, 2024, DeCastro's appeal to the Nevada Eighth Judicial District Count was heard. Judge Levitt granted his appeal and reversed his conviction, allowing him to be released from the Clark County Detention Center around July 11, 2024 after serving approximately 130 days of his sentence.

City of Henderson v. DeCastro

On June 19, 2014, Jose Maria DeCastro was charged with Failure to Obey Traffic Control Devices and Failure to Possess Drivers License or Surrender License Upon Demand. Based upon what can be viewed on the City of Henderson's website, it appears Mr. DeCastro failed to appear and the docket shows a Failure To Appear (FTA) Bench Warrant being issued in July. A similar notation also appears with a September 2, 2014, date. In October of 2014 the case was referred to a collection agency. In September of 2021 the City of Henderson appears to have closed the case and purged the warrant.

Based on the record found, it appears that on August 23, 2008, Jose Maria DeCastro was issued two citations. One for speeding and the other for failure to produce his driver's license when the officer asked for it. He plead 'Not Guilty' to the speeding citation, but the record shows he paid a fine of $190 which would indicate he was found or plead guilty. The second charge was dismissed, which is common if the person charged produces their license when appearing before the court.
