Wyant v. Mejia, DeCastro, et al

On March 1, 2024, Andrew Wyant filed an unlimited civil lawsuit for Property Damage and Personal Injury in Los Angeles Superior Court for a trafic crash that occured on March 19, 2022, around the area of Wilton Place and Santa Monica Boulevard. The Civil Case Cover sheet states that the defendants Andres Mejia and Jose DeCastro operated their vehicle negligently so as to collide with Plaintiff and cause injuries to Plaintiff. This occurred around the time that Jose DeCastro was recording a video to be used as a infomercial for his DeleteLawz YouTube channel. Comparing the photos of the actor in the informercials to photos in the IMDB database, Andres Mejia appears to be that actor. California unlimited lawsuits are for disputes of over $35,000 if filing for monitary damages, and the court filings state that the Plaintiff suffered damages of wage loss, hospital and medical expenses, other damage including future loss of earnings, future medical bills, and more.

Details of the crash are not available at this time and, in California, crash reports are not public records. If we uncover addtional informatin it will be posted here.

People v. Jose Maria DeCastro (23IN-022641)

On March 3, 2023, Mr. DeCastro had a live stream on his YouTube channel and recorded his interaction with officers from the Apple Valley Unified School District Police Department. According to statements made by the officers and Mr. DeCastro in the video, officers saw Mr. DeCastro driving while holding his cell phone in violation of California statutes. Mr. DeCastro's video shows, and he admits in the video, that he was recording the officers while the vehicle was in motion. Mr. DeCastro was issued a citation which he captured in his video and a screenshot is displayed below.

On May 6, 2023, Mr. DeCastro prepaid a fine and requested a 'Trial By Declaration.' In a trial by declaration, Mr. DeCastro was able to send in a written statement, along with any evidence he had, to the court. The officer who wrote the ticket then sent in their own written statement. A judge reviewed both and, on June 28, 2023, the Judge ruled Mr. DeCastro NOT GUILTY. After that, his prepaid fine was refunded.

DeCastro v. Peter, Clement, Pierattini, Omo Jr., Does 1-30

Complaint: Civil Defamation, Stalking, Harassment, Tortious Interference, Right To Publicity. On 02/06/2023, after having failed in Massachusetts in 2 attempts to obtain a RO against KATHERINE PETER, and rulings by the Judge in his Massachusetts Federal Case resulting in denials for many of his motions, JOSE MARIS DECASTRO has filed yet another case against MS. PETER, this time for Slander/Libel, in California State court.

On March 14, 2023, Jose Maria DeCastro filed his 1st amended complaint. While still keeping 30 John/Jane Does, he also added Daniel Clement, Michael Pierattini, and David Omo Jr to the complaint. Michael Pierattini, who has his own YouTube channel called Blue Bacon, has previously been critical of Mr. DeCastro and currently has a restraining order out of Washington State against Mr. DeCastro (see Piertattini vs DeCastro). David Omo Jr. is another YouTube creator whose channel, Team Skeptic, has also been critical of Mr. DeCastro. Mr. DeCastro previously attempted to a file restraining order against Mr. Omo Jr. which was denied due to Lack of Service.

On 10/07/2022 DECASTRO, JOSE MARIA filed a Family - Harassment lawsuit against OMO, DAVID SCOTT, JR. (a/k/a Team Skeptic). This case was filed in Los Angeles County Superior Courts, Stanley Mosk Courthouse located in Los Angeles, California. The Judge overseeing this case is GERBER, HILLARY. The Plaintiff was granted an extension of time to serve the Defendant after being unable to do so withing the original timeframe. On November 18th, when the extension ended, the case was dismissed as the Defendant still had not been served. The Plaintiff said on a YouTube video after the denial that he intends to refile. To this date, he has not.

On August 8, 2022, while possibly conducting one of his 'audits' of police during traffic stops, Jose Maria DeCastro was issued a citation for stopping, parking, or leaving his vehicle on a freeway. On November 16th, 2022, the record shows he was found Guilty in Absentia indicating a Failure to Appear.

On September 12, 2022, the record shows a trial was held in Absentia, indicating a Failure to Appear. On October 4, 2022, the record shows the case was ruled as a Conviction: Bail Forfeiture.

A May 1, 2023, notation showed up on the docket for this citation after Mr. DeCastro received a citation in 2023, (see People v. DeCastro 23IN-022641) and he called to check on the status of this citation. After he paid the 2023 citation it was noted that this hearing was then flagged as cancelled/vacated.

On June 9, 2020, Mr. DeCastro received a citation for traveling in excess of 100 MPH (Citation # KD45279). When he failed to appear on court dates in October and November of 2021, a second charge for Failure to Appear was added on November 13th, 2021. After that, Mr. DeCastro then failed to appear for a 3rd time in December of that year.

Laurence Wainer c/o Blow and Drive Interlock Corp v Ethics SCS Inc (DeCastro)

On January 3, 2018, Laurence Wainer c/o Blow and Drive Interlock Corp initiated a Small Claims lawsuit again Ethics SCS Inc, a corporation created by Jose Maria 'Chille' DeCastro. Docmentation in this case lists Jose DeCasatro as Chille DeCastro, Ethics SCS Inc and Coded Friends. A trial date of 8/23/2018 was set.

The claim was Ethics SCS Inc (Chille) owed Laurence Wainer $4,999 for a video they commissioned Ethics SCS Inc to do that was never delivered. At the time of the court filing, they claim they had paid Mr. DeCastro $6,000 for the video and had only been refunded $1,000. (See 4/26/18 Plaintiff's Claim and ORDER to Go to Small Claims Court).

On August 23, 2018, after a Non-Jury Trial, the Court ruled in favor of the Paintiff and Jose DeCastro was ordered to pay $3,999 + $245 in Court costs for a total of $4,244. Mr. DeCastro appealed the decision on October 16, 2018, and on November 19 a Trial De Novo resulted in the decision being upheld, with the only change apparently a reduction in cost from $245 to $185 for a total of $4,184.

On the Proof of Service by Substituted Service, page 2, filed on May 30th, a quote attributed to David Behrend, CEO of Hubilu, states that Mr. DeCastro "...only work(s) here one day a month."

On November 29, 2015, Jose Maria DeCastro was charged with violating California Penal Code 422(A) - Criminal Threats. The case went through numerous preliminary and pretrial hearings. On, April 8, 2023, the date of the Jury Trial, the court records found so far indicate that the case was either DISMISSED or NOT PROSECUTED with no other information provided.

Based on the dates of the violations for the cases immediately before and after this one, we believe this incident would have taken place around the end of September or the very beginning of October, 2002. The information we have found so far indicates that Mr. DeCastro may have been originally arrested and charged with Felony Manufacturing of a Controlled Substance and/or Possession of a Controlled Substance for Sale.
