Appeal of 23-DR-013015: Nevada (LVMPD) v. DeCastro

On March 26, 2024, a hearing on Jose DeCastro's appeal of his conviction and 180 day sentence was scheduled. The hearing date is July 10, 2024, at 9:00 AM.

A hearing was held on April 1, 2024, in front of Judge Zimmerman on a montion for bail and release pending his appeal. The motion was DENIED. He will not be allowed out on bail.

This is an appeal of Nevada v. DeCastro (23-CR-013015)

On July 10, 2024, the appeal was heard and GRANTED, with his conviction on Case# 23-CR-013015 reversed

Wyant v. Mejia, DeCastro, et al

On March 1, 2024, Andrew Wyant filed an unlimited civil lawsuit for Property Damage and Personal Injury in Los Angeles Superior Court for a trafic crash that occured on March 19, 2022, around the area of Wilton Place and Santa Monica Boulevard. The Civil Case Cover sheet states that the defendants Andres Mejia and Jose DeCastro operated their vehicle negligently so as to collide with Plaintiff and cause injuries to Plaintiff. This occurred around the time that Jose DeCastro was recording a video to be used as a infomercial for his DeleteLawz YouTube channel. Comparing the photos of the actor in the informercials to photos in the IMDB database, Andres Mejia appears to be that actor. California unlimited lawsuits are for disputes of over $35,000 if filing for monitary damages, and the court filings state that the Plaintiff suffered damages of wage loss, hospital and medical expenses, other damage including future loss of earnings, future medical bills, and more.

Details of the crash are not available at this time and, in California, crash reports are not public records. If we uncover addtional informatin it will be posted here.

Collin Campbell v. Jose DeCastro

According to the Maryland Judiciary website, on March 25, 2024, Collin Campbell's request for a Peace Order was granted and will be in effect until September 24, 2024.

On Febuary 26, 2024, Collin Campbell, Jose DeCastro's one-time business partner, filed for a Peace Order against Mr. DeCastro after Mr. DeCastro took to his YouTube channel, Delete Lawz, and made threats against him. A temporary order was granted and a hearing for a permanent order was been scheduled.

In Maryland, Protective Orders and Peace Orders are similiar. The difference: Protective orders apply if you are in a family-like or sexual relationship or if sexual assault has occurred; peace orders apply to all other relationships. For example between neighbors, strangers, co-workers, etc.

After filing for a Peace Order, and after the Temporary Order was issued, Collin Campbell filed paperwork requesting criminal charges be filed for a possible violation of the protection order. It appears that a criminal case was also opened and this page contains the details for the criminal case.

Currently, it cannot be determined if DeCastro has been served and there is inaccurate information, such as an incorrect date of birth and middle name, that may make the charges unenforceable.

State of Nevada (NHP) v. DeCastro

On November 22, 2023, Jose Maria DeCastro was issued a citation by the Nevada Highway Patrol while driving on the Las Vegas Freeway ( IR 15 ) at mile marker 8. While Mr. DeCastro did not release his own version of the traffic stop as he so often does, Body Worn Camera footage has been obtained and is very informative.

At the request of Jose DeCastro, the original hearing to contest his November 22, 2023, citation for Failure to Obey a Traffic Control Device was postponed and a new hearing date was set for Tuesday, April 23, 2024.

On April 23, 2024, the hearing was held and, due to his incarceration in the Clark County Detention Center as a result of a guilty verdict in Nevada v. DeCastro (23-CR-013015), Jose DeCastro was not in attendance. The Defendant was found to have commited the infraction, his $415 penalty stands and was paid from the cash bond that Mr. DeCastro was required to post to contest the citation.

On October 18, 2023, after what could be called an unsuccessful trip to Michigan to disrupt a government meeting, Mr. DeCastro was pulled over by police in Wisconsin in his rental car in the early morning hours. He recorded part of his interaction with the officer and, true-to-form, appeared agressive and forceful when communicating with the officer. While he preaches to his YouTube followers to always remain silent and not interact with the police, Mr. DeCastro's video appears to show him doing otherwise. While issuing a citation is at the officer's discresion, and often an equipment violation on a rental car may simply generate a warning, the officer in this case elected to issue Mr. DeCastro a citation.

On November 7, 2023, Jose DeCastro did not attend court but appears to have entered a 'No Contest' plea. At that time a default judgement of GUILTY was entered and a fine of $162.70 was issued. The fine was paid prior to the due date.

There has been speculation as to who paid the fine, Mr. DeCastro or the rental car company. In Mr. DeCastro's video he shows the lights operating at some point during the stop. If the light were off prior and on later, it suggests the issue may have been an operator error. As a rental car company would probably cover defective equipment, Mr. DeCastro's own video suggests that he would have been responsible for payment and not the rental car company.

DeCastro v. Las Vegas Metro. PD et al

On March 15, 2023, Jose Maria DeCastro was charged with Obstructing a Public Officer and Resisting a Public Officer when, while broadcasting live on his Delete Lawz YouTube channel, he recorded himself interfering with a Las Vegas Metro Police Department traffic stop. His information briefly appeared on the Clark County Inmate Lookup website. Based on a video posted by Mr. DeCastro a short time after the arrest appeared on the court website, and the fact that his jail information was removed within a few hours, his time in jail was relatively short.

On Tuesday, March 19, 2024, Jose DeCastro was found Guilty on both counts. He was sentenced to 90-days on each, with the sentences to run consectutively. He appealed to theNevada Eighth Judicial District Court. In the meantime, Mr. DeCastro filed a motion for bail and release pending his appeal. On April 1, 2024, Judge Zimmerman DENIED the motion. He then filed a motion for bail and release to the Eighth Judical District Court, which was denied on April 9, 2024.

On July 10, 2024, DeCastro's appeal to the Nevada Eighth Judicial District Count was heard. Judge Levitt granted his appeal and reversed his conviction, allowing him to be released from the Clark County Detention Center around July 11, 2024 after serving approximately 130 days of his sentence.

People v. Jose Maria DeCastro (23IN-022641)

On March 3, 2023, Mr. DeCastro had a live stream on his YouTube channel and recorded his interaction with officers from the Apple Valley Unified School District Police Department. According to statements made by the officers and Mr. DeCastro in the video, officers saw Mr. DeCastro driving while holding his cell phone in violation of California statutes. Mr. DeCastro's video shows, and he admits in the video, that he was recording the officers while the vehicle was in motion. Mr. DeCastro was issued a citation which he captured in his video and a screenshot is displayed below.

On May 6, 2023, Mr. DeCastro prepaid a fine and requested a 'Trial By Declaration.' In a trial by declaration, Mr. DeCastro was able to send in a written statement, along with any evidence he had, to the court. The officer who wrote the ticket then sent in their own written statement. A judge reviewed both and, on June 28, 2023, the Judge ruled Mr. DeCastro NOT GUILTY. After that, his prepaid fine was refunded.

City of Oregon v. DeCastro

On November 23rd, 2022, a complaint was lodged against Jose DeCastro. This resulted in charges of Telecommunications Harassment being filed against Mr. Decastro by the City of Oregon Police Department. He was to be held on a of $2500 if he returned and arrested.

According to the article by Jim Finch from Really Cool News over atReallyCoolSite.org:

The charges stem from a November 2022 incident where Kate Peter and DeCastro were in the side chat for a fundraiser in order to raise bail money for YouTuber Broken System Broken Trust.

Peter offered enough money on behalf of the Masshole Troll Mafia to meet the goal for the bail in exchange for a mod timing out DeCastro. Great Lakes Audits complied with the request, triggering DeCastro.

DeCastro allegedly confronted Great Lakes Audit via direct messages and continued to make threats after Great Lakes Audits asked for no more communication between the two.

Great Lakes Audit went to the police and made a police report, resulting in the warrant that was issued but never carried out since 2022. The charges were listed as “Telecommunications Harassment Knowingly Make Call to Harass or Abuse” and bond was set at $2,500.00.

The warrant has been alive but inactive since then, as DeCastro had not returned to Ohio and Oregon, Ohio, police were not going to extradite the YouTuber.

In September of 2023 Great Lakes Audit made a deal with DeCastro to drop the charges against him in exchange for DeCastro doing a fundraiser for Great Lakes Audit’s on-going legal expenses.

The planned fundraiser never materialized and while Great Lakes Audit claimed that he was going to have the charges against DeCastro lifted, he either never did or he did, and the warrant was never lifted.

It was officially lifted on June 11, 2024, when it was ordered withdrawn, and the case was dismissed without cost. No reason was given for the dismissal of the case.

Pierattini v. DeCastro

After YouTuber, Michael Pierattini (a/k/a Blue Bacon), posted a number of videos that were critical of Jose Maria DeCastro (a/k/a Delete LawZ), Mr. DeCastro posted a video on November 11th that contained personal details about Mr. Pierattini and included a threat to provide his address to someone who was 'very angry.' In his video on November 14th, Mr. Pierattini responded with a statement that he filed for a Temporary Restraining Order, along with filing complaints with other agencies, against Mr. DeCastro based on Mr. DeCastro's apparent threat and his contacting Mr. Pierattini's immediate family who have no connection to Mr. Pierattini's channel, contents and commentary. A hearing was held on January 6, 2023, and later that evening Michael Pierattini announced on his Blue Bacon YouTube channel that the Judge approved a 1-year Personal Protection Order against Jose Maria Decastro.

Ohio Supreme Court - Unauthorized Practice of Law

In August of 2022, a grievance was filed with the Disciplinary Counsel of the Ohio Supreme Court after Mr. DeCastro published a video on his 'Delete Lawz' YouTube channel where he was drafting what was reported to be a power of attorney and instructing another to sign it. While the Disciplinary Counsel agreed he likely engaged in the unauthorized practice of law, they believed they would not be able to obtain service on Mr. DeCastro and it would be "exceeding unlikely" he would respond or appear as evidenced by his evasion of the warrant for his arrest. They elected to not take further action.

They conclude the letter stating "Should we become aware of additional information regarding Mr. DeCastro's activities that might constitute the unauthorized practice of law or if Mr. Decastro returns to Ohio we will consider reopening our investigation."

People v. Jose Maria DeCastro

On August 8, 2022, while possibly conducting one of his 'audits' of police during traffic stops, Jose Maria DeCastro was issued a citation for stopping, parking, or leaving his vehicle on a freeway. On November 16th, 2022, the record shows he was found Guilty in Absentia indicating a Failure to Appear.

On July 11, 2022, Jose Maria DeCastro was issued a citation for exceeding the maximum posted speed of 70 MPH. On September 12, 2022, the record shows a trial was held in Absentia, indicating a Failure to Appear. On October 4, 2022, the record shows the case was ruled as a Conviction: Bail Forfeiture.

City of Ironton v. DeCastro

As of August 28, 2024, there is still an ACTIVE WARRANT in Ohio for this case according to the Court's website.

Charges were filed by the City of Ironton after Jose Maria DeCastro refused to leave a city building after closing hours, claiming his unpermitted 'training class' was now a 'protest'. After a court date was set regarding a possible violation of conditional release which Mr. DeCastro claimed was a 'set up,' Mr. DeCastro left town and a bench warrant was issued when he failed to appear.

State of Arizona v. DeCastro

On December 19, 2021, Jose Maria DeCastro was cited with 2 moving violations. On or about June 9, 2022, a Judge found him GUILTY of both. Based on the records available at the time of this writing, it appears Mr. DeCastro notified the court that he intends to appeal and, on May 5, 2022, a Motion to extend the time to appeal was extended.

On 09/23/2021 CHAVEZ, DINA B filed a Family - Harassment lawsuit against DE CASTRO, JOSE MARIA. This case was filed in Los Angeles County Superior Courts, Stanley Mosk Courthouse located in Los Angeles, California. The Judge overseeing this case is WARREN, JEANMARIE. The case status is Disposed - Other Disposed.

A May 1, 2023, notation showed up on the docket for this citation after Mr. DeCastro received a citation in 2023, (see People v. DeCastro 23IN-022641) and he called to check on the status of this citation. After he paid the 2023 citation it was noted that this hearing was then flagged as cancelled/vacated.

On June 9, 2020, Mr. DeCastro received a citation for traveling in excess of 100 MPH (Citation # KD45279). When he failed to appear on court dates in October and November of 2021, a second charge for Failure to Appear was added on November 13th, 2021. After that, Mr. DeCastro then failed to appear for a 3rd time in December of that year.
